Digital Content Product Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of the ProudMouth PodBlast Collection digital content product (“Product”) provided by ProudMouth (“Provider”) to the purchaser (“User”). By purchasing and accessing the Product, the User agrees to abide by the terms outlined herein:

  1. License Grant:

    1. The User is granted a non-exclusive, non-transferable license to use the Product solely for their professional use.
    2. The license is limited to the individual purchaser and may not be shared, transferred, or assigned to any other individual, entity, or professional.

  1. Restrictions:

    1. The User shall not reproduce, distribute, display, or create derivative works based on the Product for any purpose other than professional use.
    2. The User shall not share, transmit, or disclose any part of the Product, including but not limited to text, images, audio, video, or any other content, with other professionals or third parties.

  1. Intellectual Property:

    1. The Provider retains all intellectual property rights, including copyright, in and to the Product.
    2. The User agrees not to remove, alter, or obscure any proprietary notices or labels on the Product.

  1. Confidentiality:

    1. The User acknowledges that the content of the Product is confidential and proprietary to the Provider.
    2. The User agrees to take all necessary steps to prevent unauthorized disclosure or use of the Product.

  1. Use of Product:

    1. The User shall use the Product in compliance with all applicable laws and regulations.
    2. The User shall not use the Product in a manner that could harm the reputation or business interests of the Provider.

  1. Termination:

    1. The Provider reserves the right to terminate the license granted to the User if these terms are breached.
    2. Upon termination, the User must cease all use of the Product and destroy any copies in their possession.

  1. Disclaimer of Warranties:

    1. The Product is provided “as is” without any express or implied warranty, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

  1. Limitation of Liability:

    1. In no event shall the Provider be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Product.

  1. Governing Law:

    1. This Agreement shall be governed by and construed in accordance with the laws of Ontario, Canada.
    2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Ontario, Canada.

  1. Modification:

    1. The Provider reserves the right to modify these terms at any time, and such modifications will be effective upon posting on the Provider’s website.

Refund Policy

Eligibility: Due to the nature of digital products, we generally do not offer refunds. However, we will consider requests under certain circumstances, such as:

Technical Issues: If the digital product is defective or does not function as described as a result of an error on our part.
Accidental Purchase: If you believe the purchase was a genuine mistake (e.g., wrong item, duplicate order).
Restrictions:

Timeframe: Refund requests must be submitted within 7 days of the purchase date.
Usage: We may decline refunds if the digital product has been significantly downloaded, accessed, or used.
Process:

Contact: To request a refund, please contact our customer support at pmpodblasts@proudmouth.com and provide your order details and reason for the refund request.
Evaluation: We will review your request and may ask for additional information to verify your claim.
Decision: If your request is approved, we will issue a refund to the original payment method within 5-7 Working Days.
Important Notes:

We reserve the right to modify or refuse refund requests at our sole discretion if we suspect abuse or violation of our terms.
Refunds may not include any associated transaction or processing fees charged by the payment processor.

By purchasing and accessing the Product, the User acknowledges that they have read, understood, and agreed to be bound by these terms and conditions.
